The 39th Nova Scotia general election will be held when the provincial government passes "an Order in Council calling an election", as the Nova Scotia Elections Act does not provide for fixed election dates.[1]
In accordance with Section Four of the Canadian Charter of Rights and Freedoms, no assembly may continue for longer than five years from the return of the writs, which was June 19, 2009,[2] making an election probable for 2013.[3] Upon the expiration of the Legislature, on June 19, 2014, the Lieutenant Governor, is not required to call an election, however, Section Five of the 1982 charter, requires an assembly to sit once every twelve months.
