Hari Singh Gour, also known as Sir Hari Singh Gour and Dr. Hari Singh Gour, was a distinguished
lawyer ,jurist ,educationist ,social reformer ,poet , andnovelist . He was one of the greatestvisionaries ofeducation of this century on theIndian subcontinent and even on a global scale. Gour wasVice Chancellor of theUniversity of Delhi andNagpur University , founder andVice Chancellor of theUniversity of Sagar , Deputy President of theIndia nLegislative Assembly , an IndianDelegate to theJoint Parliamentary Committee , a Member of theRoyal Commission on theIndian Constitution (popularly known as theSimon Commission ), and a Fellow of theRoyal Society of Literature .
Early years
Hari Singh Gour was born on
November 26 ,1870 in a poor family nearSagar ,India . The family had to be supported by Hari Singh's eldest brother who provided an allowance of 50rupees per month. Hari Singh's father was acarpenter , but the young boy did not have an interest in this trade. At the age of ten, Hari Singh won a scholarship of tworupees per month which enabled him to attend a night school inSagar . Later, with the help of another scholarship he went toJabalpur to undertake further studies.Mathematics was his favorite subject and for this he received a special prize. He passed his Intermediate examination fromHislop College ,Nagpur , a free church institution, standing first in the whole province. This successful foundation paved the way for a bright future. Hari Singh was the only student to receive Honors in English and History.Education
When he was 18 years old, Hari Singh Gour went to the
University of Cambridge inEngland where he tookMoral Sciences Tripos andLaw Tripos . Unfortunately, the young Hari Singh experienced a great deal ofracism as astudent and throughout his life. He participated in amathematics competition , of which the results were not declared. Some years after obtaining hisLL.D. he learned that the scholarship which the competition awarded was not given to foreigners, especially "blacks," asIndia ns were referred to by the British. Since Hari Singh came first in the competition, the scholarship ended up not being awarded to any one. He faced similar treatment in other situations and academic competitions, however he never let this unfair treatment by the British discourage him. Instead, he began to writepoetry . In fact, while inEngland he came to be known in literary circles as a promisingpoet , becoming acquainted with the likes ofGeorge Bernard Shaw . He wrote a book of poetry entitled "Stepping Westward and Other Poems" due to which he became somewhat of a celebrity and was thereby selected a Member of theRoyal Society of Literature .He was admitted as a
pensioner atDowning College, Cambridge onJune 5 ,1889 . Gour received hisB.A. in 1892; the M.A. in 1896;LL.M. in 1902; and finally theLL.D. in 1908. After his time atCambridge , he read for theD.Litt. andLL.D. atTrinity College, Dublin . He received anhonorary D.Litt. from theUniversity of Delhi , where he served as the institution's firstVice Chancellor .Career
On his return to
India he became a successfullawyer atRaipur . He was called to the Bar,Inner Temple onNovember 26 ,1872 . Gour practiced in theHigh Courts of India , including theCentral Provinces ,Calcutta , andAllahabad . He wrote two monumental works, "The Law of Transfer in British India" and "The Penal Law of India". Another book entitled "Hindu Law Code" published later added to his reputation as a great jurist. In theLegislative Assembly in 1921, Dr. Hari Singh Gour denounced the sequestration and suppression ofwomen . He was also a greatsocial reformer and was successful in getting an act passed to enable women to be enrolled aslawyers , while hisCivil Marriage Bill of 1923 showed him to be areformer thinking ahead of his time. Gour was not only a progressivescholar ; he demonstrated such forward thinking in his personal life as well. He marriedGrace Kamalini Chauhan , one of the first female doctors inIndia . Hari Singh Gour wasknighted in 1925.By his determination and industry combined with a gift of oratory, Sir Hari Singh Gour rose to eminent position in the
political scene. He became aLeader of theOpposition and of theNationalist Party in theIndia nLegislative Assembly from 1921 to 1934. He was a Member of theConstituent Assembly that framedIndia ’sConstitution , working alongsideMahatma Gandhi andJawaharlal Nehru . Gour was alsoPresident of theHigh Court Bar Association inNagpur andPresident of theHindu Association . He was an IndianDelegate to theJoint Parliamentary Committee on theGovernment of India Bill in 1933.Indian Penal Code
The
Indian Penal Code was passed by theLegislative Council of India onOctober 6 ,1860 on which date it received the assent of theGovernor-General . Since that time, theIndian Penal Code had come to be the law of the land, with its amendments and modifications. However, theIndian Penal Code retained very severe means ofpunishment . Sir Hari Singh Gour vehemently opposed such measures, stating:The
Indian Penal Code was "draconian in its severity with regard to punishment," according to Gour, who firmly believed thatsolitary confinement as a form ofpunishment underSection 73 of theIndian Penal Code lacked rational basis.Solitary confinement had been abolished inEngland and Gour claimed that it would be in keeping with the civilized culture of India to wipe out this kind of punishment—an inhumane mark ironically left by the Britishcolonialists themselves in thePenal Code .Age of Consent Bill
The 1891 Age of Consent Act had established that the minimum
age of consent withinmarriage for girls should be 12 years. In 1922,Rai Bahadur Bakshi Sohan Lal proposed that theage of consent should be raised from 12 to 14. This motion was defeated. Then in 1924 Sir Hari Singh Gour brought theage of consent issue back into theLegislature with a similar proposal to raise the minimum age from 12 to 14 years for girls. After amendments and the appointment of a select committee, Gour'sBill was passed to raise theage of consent withinmarriage to 13 for girls in 1925.In March 1928, Gour, who had always been a steadfast proponent of
age of consent bills, appealed to the importance of realizing standards of modernclinical psychology and pointed out the emotional problems of early marriage, such as the incidence ofpolygamy as grooms grew up and decided they desired more compatible partners, possible occurrence ofsuicide and early death, and generally marital unhappiness for both partners.Legacy
Besides being a great
lawyer andjurist , Dr. Gour was also a greateducationist . He organized theUniversity of Delhi as its firstVice Chancellor and wasVice Chancellor ofNagpur University for two successive terms. Of his most important contributions was the founding of theUniversity of Sagar , the oldestuniversity in the state ofMadhya Pradesh , in 1946 for which he made a munificentdonation . He started theUniversity of Sagar with 20lakhs and gave about twocrores in property as adonation to theUniversity . He became the firstVice Chancellor of theUniversity of Sagar and occupied this position until he died onDecember 25 ,1949 . He bequeathed the greater part of his life's savings, a large fortune, to theUniversity of Sagar . The newcampus of thisUniversity , laid out on the summit of thePatharia Hills with a panoramic view of the town and lake, has been built largely through the benefaction of Dr. Hari Singh Gour and is a fitting memorial to this man of great vision.He accomplished much, overcoming initial
poverty and lastingdiscrimination . For example, in 1941 Gour was turned away by a hotel inEngland on account of his race. TheIndia nPosts and Telegraphs Department issued a commemorative stamp of Dr. Hari Singh Gour onNovember 26 ,1976 .Selected works
