Marks' body was trapped for nearly six months over winter before it could be flown to
Christchurch ,New Zealand , the base for American activities inAntarctica , for autopsy. Once inNew Zealand , apost mortem established that Dr Marks had died from methanol poisoning.cite web | last=Hayman | first=Kamala | url=http://www.stuff.co.nz/stuff/emailafriend/1,2582,3893767a11,00.html | title=Death in Antarctica to be revisited | publisher=stuff.co.nz | date=9 December 2006 | accessdate=2006-12-19] Both the United States and Australia agreed to a coroners inquest being held in New Zealand.cite web | url=http://www.stuff.co.nz/3935255a11.html | title=South Pole Death Mystery - Who killed Rodney Marks | publisher=Sunday Star Times | date=21 January 2007 ] Jurisdiction issues in the Antarctic are complicated; [cite journal | url=http://www.jstor.org/view/00426601/ap030398/03a00020/0 | last=Bilder | first=Richard B | title=Control of criminal conduct in Antarctica | journal=Virginia Law Review | volume=52 | issue=2 | pages=231–285 | accessdate=2007-12-07 | doi=10.2307/1071611 | year=1966 | format=dead link|date=June 2008 – [http://scholar.google.co.uk/scholar?hl=en&lr=&q=author%3A+intitle%3AControl+of+criminal+conduct+in+Antarctica&as_publication=Virginia+Law+Review&as_ylo=1966&as_yhi=1966&btnG=Search Scholar search] ] most American operations withinAntarctica —including the South Pole base—are within theRoss Dependency territory claimed by New Zealand, from where supplies are dispatched. Without accepting New Zealand’s territorial claim, Americans have not questioned application of New Zealand law to their citizens operating in the Antarctic fromOperation Deep Freeze 'sChristchurch base, while in accordance with the Antarctic treaty, New Zealand has not questioned the use of U.S. Marshals in relation to crimes involving only Americans in the Ross Dependency. New Zealand Police , at the direction of Richard McElrea, theChristchurch coroner . A formal verdict has yet to be entered; a 2006 series of Coroners Court hearings and statements to the media raises questions from both the police and the Coroner’s Court if Dr Marks poisoning was intentional. DSS Wormald said, "In my view it is most likely Dr Marks ingested the methanol unknowingly."cite web | url=http://www.70south.com/latest-antarctic-news/aussie-may-have-been-poisoned/ | title=Aussie may have been poisoned | publisher=70South Antarctic News | date=13 December 2006 | accessdate=2006-12-19] cite web | last=Hotere | first=Andrea | url=http://www.stuff.co.nz/stuff/sundaystartimes/3902305a6442.html | title=South Pole death file still open" | publisher=Sunday Star Times | date=17 December 2006 | accessdate=2006-12-19]Dr Marks had been a binge drinker, using alcohol to mask his
Tourette syndrome . However DSS Wormald stated it was not credible to believe he had accidentally drunk themethanol , when he had ready access to a large supply of alcohol. Dr Marks had recently entered a new relationship, had nearly completed important academic work and had no financial problems. He had promptly sought treatment for an illness that confused him, and there was no reason to suspect suicidal intent.cite web | last=Booker | first=Jarrod | url=http://www.nzherald.co.nz/section/1/story.cfm?c_id=1&objectid=10415310&ref=rss | title=South Pole scientist may have been poisoned | publisher=The New Zealand Herald | date=14 December 2006 | accessdate=2006-12-19]DSS Wormald indicated that Raytheon and the National Science Foundation had not been cooperative. DSS Wormald stated, regarding the NSF conclusion that Dr Marks death was from natural causes: "We wanted the results of [the NSF] internal investigation and to get in contact with people who were there to ask them some questions," said Wormald. "They weren't prepared to tell us who was there "... "they have advised that no report exists. To be frank, I think there is more there; there must be", Wormald said. "I am not entirely satisfied that all relevant information and reports have been disclosed to the New Zealand police or the coroner".cite web | last=Chapman | first=Paul | url=http://www.telegraph.co.uk/news/main.jhtml?xml=/news/2006/12/14/wpole14.xml | title=New Zealand Probes What May Be First South Pole Murder | publisher=

The U.S. Department of Justice also failed to obtain answers from the two organisations, which appeared to have denied jurisdiction.cite web| publisher=

In September 2008, the written report resulting from the December 2006 inquest was released. The coroner could not find evidence to support theories of a prank gone awry nor foul play nor suicide. The cause of the fatal methanol poisoning has never been determined, and the Marks family has given up hope of learning what happened. Paul Marks, Rodney's father, is quoted as saying "... And I don't think we are going to try to find out any more in regards to how Rodney died. I'd see that as a fruitless exercise." Memorial
Marks Mount, a 2600 metre high mountain in
Worcester Range (78o47'S, 160o35'E) is named after Dr Marks. A plaque was erected at the base, and the site of the South Pole in January 2001 is marked by a memorial to him, (the glacial ice covering the pole moves around 10 metres per year).
