Born in Ford Bank, Didsbury, Manchester, Birley died in Didsbury and is buried in St. James's Church.

His father was Joseph Burley (1782 - 1847), who was the brother of Hugh Hornby Birley, who were the sons of Richard Birley (1743 - 1812), merchant.

His nephew Francis was an England international footballer who won the FA Cup three times, and his niece Caroline was an eminent geologist.Fact|date=February 2008
