Homosexuality is illegal in Sudan. The judicial system is based on the Shari'a and according to Article 148, capital punishment applies should the offense be repeated for the fourth time for women, and the first for men. For homosexual men, the death penalty is used on the first act.

For lesbian women, the first three acts of homosexuality are punished with 100 lashes, and on the fourth offense, death.
