Slave Codes of 1705

Slave Codes of 1705

The Slave Codes of 1705 were a comprehensive series of laws enacted by the Colony of Virginia's House of Burgesses to regulate the growing slave population in Virginia. [For an overview of the Virginia Slave Code, and the general evolution of slave codes in Colonial America, see, e.g., http://www.understandingrace.org/history/gov/colonial_authority.html]

The Slave Codes of 1705 defined "slave" as " [a] ll servants imported and brought into the Country...who were not Christians in their native Country." The Code further provided that slaves would be considered by the law as real estate, not human beings. Accordingly, "if any slave resist his master... correcting such slave, and shall happen to be killed in such correction...the master shall be free of all punishment...as if such accident never happened." As real property, the codes specified that slaves could be used both as collateral for borrowing money and as assets in the payment of debts.

The Virginia Slave Code of 1705 subsequently served as a model for other colonies.
