Offshore divers v. Norway 2008

24 professional offshore divers sued Norway's Government in a trial in 2008.[1] All the plaintiffs (who saw the case through) lost their claims for tortious compensation.[2]

Norwegian media (including Aftenposten) wrote about the upcoming case as early as 2006.[3]

Trial

The trial started January 28, 2008 in Oslo District Court.[4] (The cases of the 19 separate plaintiffs were tried together, as a result of previous decisions by the court.[5])

The plaintiffs were Rolf Engebretsen, Tom Engh, Einar Andersen, James Cronin, Inge Eriksen, Jan Eriksen, Tor Gudmestad Tom Halvorsen, Lars Hasle, Tom Helgesen Johan Johansen, Kjell Lilledal, Tony Martinsen, Geraldine Martin, Bjarne Nordstrand, Tord Solberg Jahn Steinkjær, Patrick Stevens and Dag Trondsen.[6] (5 additional plaintiffs pulled their lawsuits before the end of the trial.[7])

The proceedings were recorded on audiotape by Nordsjødykkeralliansen(NSDA) (acting as hjelpeintervenient) — and by the court.[8]

Verdict

"The Government is not the employer of the divers, and therefore there is not a sufficient connection at present, for it to hold liability.", was part of the verdict of Oslo District Court.[9] "Human considerations say that the liability for tortious compensation should be extended, so that those divers who suffered (senskade) injury symptoms after offshore diving in the North Sea sector of Norway, receive full compensation."[10]
