"American Indian or Alaskan Native", an official U.S. racial category legally refers to people having "origins in any of the indigenous peoples of the Americas residing in the United States".cite web |url=http://quickfacts.census.gov/qfd/meta/long_68178.htm |work=U.S. Census Bureau |title=2000 Census of Population, Public Law 94-171 Redistricting Data File: Race ] White Hispanics with brown complexion and darker hair and mestizos with more caucasian features, brown complexion, and darker hair may be considered Hispanic Amerindian by mistake as mestizos with more Caucasian features and white complexion may be considered as white Hispanics.

Hispanicity, which is independent of race, is the only "ethnic" category, as opposed to racial category, which is officially collated by the U.S. Census Bureau. The distinction made by government agencies for those within the population of any official race category, including "American Indian or Alaskan Native", is between those who report Hispanic backgrounds and all others who do not. In the case of American Indians and Alaskan Natives, these two groups are respectively termed Hispanic Amerindians/Hispanic Native Americans and non-Hispanic Amerindians/non-Hispanic Native Americans, the former being those who report indigenous American ethnicity as well as a Hispanic ancestral background (Spain and Hispanic Latin America), and the latter consisting of an ethnically diverse collection of all others who are classified as Native American/American Indian or Alaskan Native that do not report Hispanic backgrounds.
