Cheshire, Connecticut , Mallary was graduated fromMiddlebury College in 1805.He moved toPoultney, Vermont , studied law, was admitted to the bar and commenced practice in Castleton, in 1807.Mallary was elected trustee of the Rutland County Grammar School, Secretary to the Governor and Council, State's attorney for Rutland County. As a Democratic-Republican, he successfully contested the election of
Orsamus C. Merrill to the Sixteenth Congress.Mallary was elected as a Democratic-Republican to the Seventeenth Congress, reelected as an Adams-Clay Democratic-Republican to the Eighteenth Congress, elected as an Adams candidate to the Nineteenth and Twentieth Congresses, and reelected as an Anti-Jacksonian candidate to the Twenty-first and Twenty-second Congresses and served from
January 13 ,1820 , until his death inBaltimore, Maryland onApril 15 ,1831 . He served as chairman of the Committee on Manufactures (Nineteenth through Twenty-first Congresses). He was interred in East Poultney Cemetery, East Poultney, Vermont.ource
