In 2007, he was one of the judges who declared on a petition challenging military dictator's candidature for the second term as the president as non maintainable. However, he refused to take oath as the Chief Justice of Pakistan under PCO in 2007 after military dictator suspended constitution and restricted fundamental rights in the country.

Javid Iqbal (Sr.), son of the poet-philosopher Allama Muhammad Iqbal, was also a judge of Supreme Court and Chief Justice of Punjab High Court in 1980s and 1990s. He is presently under house arrest in Quetta, Pakistan for not taking oath under the PCO.References
