Thirty-ninth Amendment of the Indian Constitution

Thirty-ninth Amendment of the Indian Constitution was passed by the Indian parliament on September 26, 1975 in Indian Emergency (1975 - 77). The amendment placed the election of the President, the Vice President , the Prime Minister and the Speaker of the Lok Sabha beyond the scrutiny of the judiciary.

It was passed by the parliament during the Indian Emergency (1975 - 77). It was mooted by the Congress government headed by Indira Gandhi to preempt hearing by Supreme Court of India of the case of the setting aside of her election by Allahabad High Court for corrupt electoral practices.
