2004 , is a court case involving UnitedStatesCode|28|1782, which authorizesUnited States district court s to enforce discovery requests made in connection with litigation being conducted in foreign tribunals. Prior to "Intel", there had been substantial disagreement as to the availability ofSection 1782 Discovery .The "Intel" case originated from
Advanced Micro Devices 'santitrust claims againstIntel in Europe. AMD filed a complaint against Intel in theEuropean Union 's antitrust enforcement agency (theDirectorate-General for Competition ), and then filed a lawsuit in the U.S. for discovery of certain Intel documents in order to further their complaint. The Court decided that Section 1782 only "authorizes, but does not require" U.S. district courts to provide discovery aid. Nearly three months after this ruling Intel declared the ruling unjust and is still disputing the charges and has filed for appeal.
