The Marked traces its origins to 1983, when Billy Corgan met Greg Bates outside of teen nightclub Medusa's. Corgan and Bates, both vocalists and guitarists, began writing songs and soon formed a band, Coat of Eyes. Two years later, the band was expanded to include bassist Dale Meiners and drummer
Ron Roesing .Jim Marcus also contributed to a few songs.In 1985, Corgan graduated high school and decided to pursue music full-time. Fearful of a cold reception in their native Chicago, the band, minus Greg Bates, moved to
St. Petersburg, Florida and renamed themselves The Marked, after Corgan and Roesing'sport-wine stain s. The band were reported to have played around 20 shows in and around St. Petersburg before Meiners suddenly quit the band. Corgan and Roesing reluctantly returned to Chicago. The band continued, with Meiners briefly replaced by Len Ayala.In 1987, Corgan devised the name "Smashing Pumpkins" and set about to start a new band. He met
James Iha and, with Roesing, began playing as a three-piece with Corgan on bass. This lineup ofSmashing Pumpkins produced one self-made and exceptionally rare demo tape, "Nothing Ever Changes", before Roesing departed.In
2000 , The Marked reappeared in a lawsuit against Billy Corgan, the Smashing Pumpkins,Virgin Records America, andModivational Films for breach of contract, breach of confidence, fraud and deceit, negligent misrepresentation, declaratory relief, constructive trust, and injunctive relief stemming from the use of a several clips of The Marked in the 1994 Smashing Pumpkins videoVieuphoria .JM Productions (
Jonathan Morrill ) objected to the use of band footage taken from his short film "Video Marked". Morrill was an associate of the band during its lifespan, who Corgan stayed with temporarily during his time in Florida. He is also likely the inspiration behind the title of "Song for Jonathan". Billy Corgan scored an instrumental song for an animated film that Morrill had produced in 1978, and labled the audio cassette "Song for Jonathan"Fact|Jonathan Morrill / August 2008)In court documents Morrill stated there were only two copies of "Video Marked", which appears to essentially be a video for the song "The Trance", and excerpts from "Stained Glass Window", as well as rehersal footage of the band at practice. Morrill claimed Corgan confiscated the backup tape without his permission, and was unaware of the content of Vieuphoria until
1999 .Morrill states he approached Corgan in
1996 about the release of "Video Marked" and other content but Corgan was apprehensive about any plans, citing the quality of available materials. Morrill also objected to the packaging of the video which advertised "super secret material shot by the band" yet failed to credit his work.Morrill produced, without charge of any kind, many music videos for The Marked. Morrill filmed, directed, conceived, and edited music videos for the Marked songs "Stained Glass Window", "Scary Neurotic Song", "The Trance", "Anima Animus", "Passion To Despise", "The Dream" and "Pelican"
The case, Morrill v. The Smashing Pumpkins (157 F. Supp. 2d 1120) was resolved when the court granted the Smashing Pumpkins' motion for summary judgment on Morrill's claims of copyright infringement,
fraud anddeceit , and breach of confidence.However, it is a fact that the editor(s) of Vieuphoria did lift several sequences from Morrill's documentry "Video Marked", without giving any compensation or credit to Morrill.
In spite of the nasty lawsuit, Morrill insists there was no animosity towards Corgan, and that the lawsuit was a David and Goliath scenario, and Morrill just wanted fair compensation for his work, since profit was made by Virgin America off of the sweat of his labor.
