In September 2008, police charged the manager of the
Lexington, Kentucky location with failure to "report dependency, neglect and abuse", amisdemeanor . Customers had reported there was a three-year-old child locked in a hotvan in the store's parking lot, who wasn't responding to knocks on the van's windows. The customers asked to use the store's phone to call9-1-1 . Citing a corporate policy against getting involved with events in store parking lots, the manager refused to allow the call or use the storeintercom to attempt to contact the child's parents.A
cell phone was eventually used to call police, who broke the van's window and retrieved the child, whose mother was charged with first-degreechild endangerment .
