Burnet Maybank III

Burnet Maybank III is a lawyer, author and was a former two time director of the South Carolina Department of Revenue under former Governor David Beasley and current Governor Mark Sanford. He was first director of the SCDOR in the history of South Carolina. He comes from a family that is rooted deep in politics. His grandfather was the former Senator and Governor of South Carolina, Burnet Maybank and his father was the former Lieutant Governor of SC, Burnet Maybank II. He has testified in front of the United States Senate about his work on charitable tax deductions.

Life

Mr. Maybank grew up in one of Charleston's oldest families. In his youth he attended the prestigious Porter-Gaud School, and graduated from the distinguished boarding school, St. Paul's School (Concord, New Hampshire) (which is included in Saint Grottlesex) in 1974. He attended the University of North Carolina at Chapel Hill and graduated there in 1978. Maybank received his JD from the University of South Carolina Law School in 1981.

Mr. Maybank is a member of the Nexsen Pruet Jacobs and Pollard law firm (the second biggest law firm in South Carolina) working in the firm's Columbia and Charleston offices, and he served for four years as the first Director of the South Carolina Department of Revenue. He concentrates on economic development, local and state tax issues, maritime, and administrative law. He has also won the highest possible award for a South Carolina citizen, the Order of the Palmetto. For one day in 2006, a special South Carolina flag was flown over the South Carolina statehouse in honor of Mr. Maybank's public service to South Carolina. 7-10 years ago Burnet seriously considered a bid for US congress as a representative of South Carolina.

Maybank received national press in 2005 regarding the Department of Revenue's investigation of potentially abusive conservation easement donations, as well as the Department's investigation under IRS Circular 230 of tax professionals who were involved in tax shelters.

He received his B.A. Degree from the University of North Carolina, his J.D. Degree from the University of South Carolina, and a LLM in Taxation Degree from Emory University.

He also served as Legal Counsel to Governor Carroll A. Campbell, Jr., as Deputy Securities Commissioner and General Counsel in the Secretary of State's Office, as a Commissioner on the South Carolina Public Service Commission, and as a member of the Board of DHEC. He served for three years as Chairman of the Enterprise Zone Subcommittee of the Coordinating Council for Economic Development.

He is co-author of a number of books and law review articles including "South Carolina Tax Incentives for Economic Development", "Local, State, and Federal Tax incentives for Conservation Easements", and "State Tax Crimes", all published for the Department of Revenue. He also co-authored "Summary of South Carolina Not-for Profit Laws, 21.3 The Exempt Organization Tax Review" (September, 1998) and "Limited Liability Companies", as well as several books on insurance published by the South Carolina Bar. He was the lead co-author and lobbyist of the three economic development bills over the past four years: the Enterprise Zone Act, Rural Development Act, and the Fee-in-Lieu Simplification Act.
