Kilbourn Test

Kilbourn Test

The Kilbourn Test derived from the landmark United States Supreme Court case, Kilbourn v. Thompson. Here the court established several limits on the scope of investigations.

1) Must not invade areas constitutionally reserved to the courts or the executive 2) must deal with subjects on which Congress could validly legislate 3) must suggest, in the resolutions authorizing the investigation, a congressional interest in legislating on that subject
