"Shanklin Pier v Detel Products Ltd", (1951) 2 K.B. 854 is a leading English decision on collateral contracts.

Background

The owner of Shanklin Pier hired a contractor to paint the pier. The owner had specifically requested that the contractor use paints by Detel Products based on representations made by the paint manufacturer that it was suitable and would last seven years. The paint turned out to not be any good and lasted only 3 months. Shanklin Pier sued the paint manufacturer.

Decision

The Court found that there was a collateral contract based on the representation of Detel. The consideration was found in the plaintiff's request to the contractor to use Detel's product.
