- Paul BW Chaplin
Biography
Paul BW Chaplin was born of Anglo-Brazilian parents, but was orphaned and grew up in a variety of Children's Homes. He took a degree in
law atHertford College ofOxford University and went on to qualify as abarrister and latersolicitor . He worked in taxation law at the Bar inLincoln's Inn and then in various City law firms andArthur Andersen , before establishing his "Baxendale Walker" practice inMayfair in 1994.The Baxendale Walker Firm
Since then, his eponymous firm Baxendale Walker LLP has grown to be one of the leading wealth and tax advisory boutiques in the world, offering consultancy services to high net worth companies and individuals in the
UK ,Europe and theUSA .The Baxendale Walker name first came to public prominence as a result of his professional writings, beginning with his 1997 book "The Law and Taxation of Remuneration Trusts", which he co-authored with Andrew Thornhill QC. The book established his reputation as a leading and innovative tax and trusts strategist. It became referred to publicly by the
Inland Revenue (HM Customs & Excise) as the "bible" on the subject. Paul went on to publish his seminal work on the law ofpurpose trust s in 1999. He has written extensively for professional journals [ [http://www.baxendalewalker.com/pdf/eurolaw.pdf European Wealth Management] ] and spoken at countless seminars, including the Conservative Party Conference, standing out againstOECD intervention in the affairs of sovereign states [ [http://www.caymannetnews.com/Archive/Archive%20Articles/December%202002/Issue%20296/OECD%20harmful.html Cayman Net News: OECD Harmful Tax Initiative Accused of Violating UN Charter] ] .The Baxendale Walker name became even more prominent when he was wrongly accused by the Serious Fraud Office of having been involved in a conspiracy to defraud the Balfron pension scheme. His innocence was declared by Mr Justice Etherton in the High Court, yet the SFO attempted to continue their prosecution of him, finally resulting in their prosecution being stayed at
Southwark Crown Court, after just 1 day of hearing. [ [http://www.thelawyer.com/cgi-bin/item.cgi?id=99759 thelawyer.com: Judge stays Baxendale-Walker fraud case] ] The SFO was ordered to pay Paul over £1 million in compensation. It was the first time in British legal history that a professional had defended himself in this way against the SFO and the case became another significant mark against the already beleaguered institution.Pressed by the SFO, the Law Society then began a campaign to try and end his status as a solicitor. Paul resigned his membership of the Law Society after he uncovered a major
scandal , in which documents obtained by Court Order, together with tape transcripts, showed that senior officers of the Society had corruptly conspired to manufacture false evidence against him, for the purposes of fabricating a case against him. The Law Society's case was thrown out by Lord Phillips, and the Law Society had to pay Paul half a million pounds in compensation. Paul then successfully sued an accountant who acted in the conspiracy [ [http://www.accountancymagazine.com/croner/jsp/Editorial.do?cache=true&channelId=-305030&contentId=810743&Failed_Reason=Session+not+found&com.broadvision.session.new=Yes&BV_UseBVCookie=No&Failed_Page=%2fjsp%2fEditorial.do&BV_UseBVCookie=yes Accountancymagazine.com: Tax specialist sues Deloitte] ] and won damages and costs fordefamation . The Society then brought a fresh round of invented allegations against him, some of which were thrown out. They then persuaded their own adjudication body, the Solicitors Disciplinary Tribunal, to strike him off on the grounds that he had a conflict of interest in marketing his own tax products through his own company. No evidence was offered by any client or professional. The Society was unable even to claim that any client had been prejudiced, and despite them writing to several clients to ask them to complain, none did. The basis of the decision was that there existed a conflict of interest because he was unable to criticise his own advice. Several senior commentators have described the decision as "ludicrous" and "illogical and absurd".Paul has continued growing the successful Baxendale Walker firm, and since expanded his advisory practice to the United States.
