Mayfield v. United States

Mayfield v. United States, 504 F. Supp. 2d 1023, is a case heard in the United States District Court for the District of Oregon in 2007.

Plaintiff, Brandon Mayfield, requested a declaratory relief that several parts of the USA PATRIOT Act were unconstitutional under the Fourth Amendment.

He had personal standing to ask for such a relief derived from the actions of the defendant, United States government, which he claimed violated his Fourth Amendment rights when it wiretapped him and his family, after he was suspected of involvement in the 2004 Madrid train bombings.

On September 26, 2007, Judge Ann Aiken reached summary judgment in favor of the plaintiff.

Appeal

The case was heard by the Ninth Circuit on February 5, 2009. On December 10, 2009 the court ruled that Mayfield lacked standing due to the terms of a settlement he reached with the government.
